Who are we and where can you find us? Your personal data is processed by joint operators, namely the following companies from the PERSONALITY group: 1. 2. Basic data from the contract of joint operators.

The companies belonging to the PERSONALITY group have entered into a Joint Operator Agreement pursuant to Article 26. Regulations in which they agreed on the rules for sharing databases that they create and use together. They also agreed that the organizational and security rules for databases are determined by Personality, s.r.o. with its registered office at Svätoplukovo námestie 1/B, Nitra 949 01, IČO 44 549 733 (hereinafter referred to as the "Company"), this Company also represents all joint operators vis-à-vis data subjects, is the point of contact for data subjects, cooperates with supervisory authorities and exercises other rights and obligations of the operator according to the Regulation. Despite the existence of a contract of joint operators, you can exercise your rights with any company from the PERSONALITY group, but it will be fastest if you contact the Company at the above contact address.

A. Job seekers

Affected persons: In this case, the affected persons are natural persons who contacted the Personality group electronically, by telephone, in person, by letter or in any other way in response to a specific published advertisement or offer of employment or a job position with a specific employer (hereinafter referred to as "applicants")

 


What data do we process, on what legal basis, for what purpose and for how long.

 


Scope of personal data: In the event that you respond to a specific offer of employment or a job position made in any form or respond to an advertisement or information about a vacant position of a specific employer or the PERSONALITY Group for a specific employer (hereinafter referred to as the "offer"), we process your personal data in the scope of the response form and the data required in the offer, which are, in particular, name, surname, title, date of birth, address, email, phone number, professional history, language skills, education, salary expectations, further data listed in the applicant's CV, public profiles on personal networks and other documents that you have provided to us and the data mentioned in the records of the interviews that you have completed with the PERSONALITY Group or with a potential employer.

Processing purposes:

identifying and recommending suitable applicants for a job position, checking whether applicants meet the requirements and needs of a specific employer and the process of hiring an employee or worker for a job position (hereinafter referred to as the "selection process") as well as the preparation of an employment contract or other similar private law contract or agreement between the applicant and future employers.

Provision of applicant data to potential employers for the purposes of the selection process and selection of employees or workers for a vacant position, as well as the preparation of an employment contract or other similar private law contract or agreement between the applicant and the future employer.

Applying, defending and proving the legal claims of the PERSONALITY group and employers related to the hiring process of the job applicant or the services provided by the PERSONALITY group to the employer.

Archiving, scientific research or statistical purposes.

Legal basis

The legal basis for the processing of applicants' personal data for the purposes of points 1 and 2 above is Article 6 para. 1 letter b) Regulations, i.e. the fact that the processing is
necessary so that, based on the request of the person concerned, measures are taken before the conclusion of the contract (pre-contractual relationship between the applicant, PERSONALITY and the potential employer).

For the purpose according to point 3, the legal basis is Art. 6 par. 1 letter f) Regulations, i.e. the existing legitimate interest of the PERSONALITY Group and/or the employer in applying, defending and proving the legal claims of the PERSONALITY group and/or employers related to the hiring process of the job applicant or the services provided by the PERSONALITY group to the employer.

For purpose 4, the legal basis is in accordance with Art. 6 par. 1 letter c) Regulations on the fulfillment of the legal obligation of the operator, resulting mainly from Act 395/2002 Coll. on archives and registries and on the addition of some laws.

Processing time

For purposes 1 and 2, personal data is processed until the employer completes the selection process for a specific offer and selection of a specific employee.

For the purposes of point 3, the data is processed until the statute of limitations for private law claims expires, i.e. for a maximum of 4 years from the end of the selection process and, in the event that any legal claims proceedings have been initiated, then until the legal termination of all proceedings and the recovery of all performance related to it related.

For the purposes according to point 4, the processing time is determined by the storage period of the record, resulting from the law or registry regulations, as a rule, 5 years.

 


Categories of intermediaries or other recipients of data:

The PERSONALITY group provides personal data of applicants and candidates to third parties, which are natural or legal persons or institutions based in the European Union, which are looking for or recruiting employees or workers for vacant work or similar positions (hereinafter referred to as the "employer"). The employer is an independent operator within the meaning of the Regulation.

In addition, the PERSONALITY Group provides personal data of applicants and candidates to intermediaries who provide the PERSONALITY Group with services and activities related to the processing of personal data, namely:

External workers and suppliers: Natural or legal persons based in the EU who provide the PERSONALITY Group with work or services related to its main activity, in which the provision or processing of personal data occurs or may occur, in particular external advisers and coordinators of the selection process, lecturers, other persons coordinating the selection process or processing its results for the PERSONALITY group.

Accounting, tax and legal advisors: Natural or legal persons based in the EU who provide the PERSONALITY Group with accounting, tax

B. Candidates for Employment

Affected persons: In this case, the affected persons are persons who responded electronically, by telephone, in person, by letter or in any other way to the invitation or opportunity of the PERSONALITY group to be included in the database of job candidates, i.e. persons to whom information about job offers may be sent and who they may be approached as candidates for positions not specified in advance and whose data may be provided to employers not specified in advance, looking for employees or workers, and who have given voluntary consent to such processing (hereinafter referred to as "candidates").

 


What data do we process, on what legal basis, for what purpose and for how long.

Scope of personal data: The PERSONALITY group processes personal data of candidates to the extent that they are listed in the contact form or found out in a personal or telephone conversation or found out from publicly available sources by the PERSONALITY group after the candidate has expressed interest in being included in the candidate database, usually in the range of name, surname, title, date of birth, address, e-mail, telephone number, professional history, language skills, education, salary expectations, further data specified in the curriculum vitae and other documents you provided us and data specified in the records of the interviews you completed with By the PERSONALITY group and data from publicly available data sources (especially social networks, public speeches).

Processing purposes:

Operating a database of candidates for employment, including the possibility of sharing their personal data with unspecified clients of the PERSONALITY Group and contacting the candidate if he is a suitable candidate for a job position with an unspecified candidate

Applying, defending and proving the legal claims of the PERSONALITY group and employers related to the hiring process of the candidate for employment or the services provided by the PERSONALITY group to the employer.

Archiving, scientific research or for statistical purposes.

Legal basis

The legal basis for the processing of personal data of candidates for purpose 1 is the consent of the candidate in the sense of Art. 6 par. 1 letter a) Regulations.

For purpose 2, the legal basis is Art. 6 par. 1 letter f) Regulations, i.e. the existing legitimate interest of the PERSONALITY Group and/or the employer in applying, defending and proving the legal claims of the PERSONALITY group and/or employers related to the hiring process of the job applicant or the services provided by the PERSONALITY Group to the employer.

For purpose 3, the legal basis is in accordance with Art. 6 paragraph. 1 letter c) fulfillment of the legal obligation of the operator, arising mainly from Act 395/2002 Coll. on archives and registries and on the addition of some laws.

Processing time

For purpose 1, personal data is processed for the period specified in the consent, usually 3 years from its granting or until the consent is revoked, if it occurs earlier.

For the purposes of point 2, the data is processed until the statute of limitations for private law claims expires, i.e. for a maximum of 4 years from the end of the selection procedure in which the candidate's data was provided, and in the event that legal claims proceedings have been initiated, then until the legal termination of all proceedings and the enforcement of all performance related to it.

For the purposes of point 4, the processing period is determined by the storage period of the record, resulting from the law or the registry, as a rule, 5 years from the end of the calendar year in which the data were obtained.

The PERSONALITY group provides personal data of applicants and employees to third parties, which are natural or legal persons or institutions based in the European Union, which search for or recruit employees or workers for vacant or similar positions (hereinafter referred to as the "employer"). In addition, the PERSONALITY Group provides personal data of applicants and candidates to intermediaries who provide the PERSONALITY Group with services and activities related to the processing of personal data, namely:

IT services and IT platforms: Natural and legal persons based in the EU who are authors, operators or administrators of electronic platforms or social networks through which PERSONALITY communicates with employers, applicants or candidates, conducts online seminars, online interviews or transmits or stores information

C. Persons interested in the webinar, online training or e-publications

Affected persons: For this case, the affected persons are natural persons who contacted the Personality group electronically, by telephone, in person, by letter or in any other way in response to the offer of a webinar, training, seminar or other educational or informational event (hereinafter referred to as the "event") or requested about sending an electronic publication.


What data do we process, on what legal basis, for what purpose and for how long.


If you respond to the possibility of a paid or free webinar, seminar, training or other educational event organized by the PERSONALITY group or request to send an electronic publication, you fill out the contact form with the following personal data: title, first name, last name, email, phone number, profession, employer.

We will use this personal data for the following purposes:

Organization of the event: i.e. to allow you personal or electronic access to the event, organized by the PERSONALITY group at the time and on the topic indicated in the event form or offer;

Consultations: if it is indicated in the event offer, then also to provide you with a time-limited opportunity for a telephone or online consultation on the topic of the webinar

Delivery of requested content: If it is a matter of sending an electronic publication, so that we can deliver the requested publication to you.

Applying, defending and proving the legal claims of the PERSONALITY group related to the services provided by the PERSONALITY group

Tax and accounting purposes within the meaning of the applicable legal regulations regarding paid services/events and within the scope of the data according to the applicable regulations (identification, contact data and data on the payment made or owed)

Archiving, scientific research or for statistical purposes.

By sending the completed form and approving the terms of the event, you enter into a contract with the company from the PERSONALITY Group, which organizes the event, for a free or paid (according to the terms of the event) consulting service, on the basis of which the Company undertakes to allow you access to the event, or to enable a personal consultation at a specified time period of time from the event you signed up for, or to provide informational and educational publications created by the PERSONALITY group.

Legal basis

The legal basis for the processing of personal data of event participants and candidates for the purposes of points 1-3 above is Article 6 paragraph 1 letter b) Regulations, i.e. the fact that the processing is necessary in order to take measures based on the request of the person concerned before concluding the contract (pre-contractual relationship between the applicant and the company from the PERSONALITY Group, which organizes the event or provides electronic content).

For the purpose according to point 4, the legal basis is Art. 6 par. 1 letter f) Regulations, i.e. the existing legitimate interest of the PERSONALITY Group in applying, defending and proving the legal claims of the PERSONALITY Group related to the services provided by the PERSONALITY Group to the employer.

For purpose 5, the legal basis is in accordance with Art. 6 par. 1 letter c) Regulations on the fulfillment of the legal obligation of the operator, resulting mainly from the accounting law and tax regulations.

For purpose 6, the legal basis is in accordance with Art. 6 par. 1 letter c) Regulations on the fulfillment of the legal obligation of the operator, resulting mainly from Act 395/2002 Coll. on archives and registries and on the addition of some laws.

Processing time

For purposes 1, 2 and 3, personal data are processed for the time necessary to fulfill obligations and duties related to the event, publication or consultation. In the case that it is a payment mentioned in the consent, as a rule, 3 years from its granting or until the consent is revoked, if it occurs earlier.

For the purposes of point 4, the data is processed until the statute of limitations for private law claims expires, i.e. for a maximum of 4 years from the end of the event/offer during which the data was obtained.

For the purposes of points 5 and 6, the processing period is determined by law or the storage period of the record, resulting from the law or the registry, as a rule, 5 years from the end of the calendar year in which the data were obtained.

What data do we process, on what legal basis, for what purpose and for how long.

E. Contractual partners of the PERSONALITY Group, members of statutory bodies and contact persons of contractual partners

Affected persons: Affected persons are natural persons who are contractual partners of the Personality Group or members of the contractual partners' statutory bodies and their contact persons.

What data we process, legal basis, purposes and periods of processing

Purpose We process the personal data of contractual partners – natural persons as well as members of statutory bodies of contractual partners and their contact persons for the following purposes:

For the purpose of preparing, concluding and fulfilling the contract with the contractual partner

fulfillment of legal obligations (especially according to the Act on Accounting, the Act on Income Tax and the Act on Archives and other legal regulations)

Checking the authorization to act on behalf of the contractual partner and contacting the contractual partner with regard to the personal data of persons who act on behalf of our contractual partners (statutory officers, senior employees) or are their contact persons according to the contract for the purpose of fulfilling contractual obligations according to our contracts, contacting contractual partners and records of documents on which their data are listed in accordance with legal regulations.

In case it is necessary to apply, prove or defend the legal claims of a company from the PERSONALITY group,

The legal basis is

According to Art. 6 par. 1 letter b) Regulations, i.e. processing is necessary for the performance of a contract to which the affected person is a party, or to take measures based on the request of the affected person before concluding the contract, if it is a contractual partner – a natural person;

Art. 6 par. 1 letter c) the legal obligation of the operator in cases where the law imposes an obligation to register or report documents on which their personal data are listed, in particular the Income Tax Act and the Accounting Act

Art. 6 par. 1 letter f) Regulation of the legitimate interest of the Company in fulfilling contractual and legal obligations, or in contacting contractual partners through a contact person, with regard to the personal data of persons who act on behalf of the contractual partner or are its contact persons or are contractual partners-legal entities and

Art. 6 par. 1 letter f) Regulation of the legitimate interest of the Company – applying, proving and defending legal claims in the event that the data is necessary for the purpose of applying, defending and proving legal claims.

Categories of personal data: We process personal data in the scope of title, first name, last name, function (position), telephone, email, or other contact information specified in the contract.

Processing period We process personal data for the duration of the contract in which it is stated or for the fulfillment of which it is used. After the end of the contract, we still process this personal data during the limitation period for claims (usually 4 years) for the purpose of defending, proving and exercising legal claims, or, if during that period proceedings on the Company's claims or obligations have begun or are threatened, until the end of such proceedings and full resolution of all claims. Personal data on documents and documents, which are subject to mandatory records or archiving, are further stored for the duration of the period of archiving or records.
